Liability

Stems from mainly two sources being either contractual or delictual, the former comprising of consent, the latter, an unlawful act or omission.

Contracts

Most rights and obligations in business stem from contracts. It is thus important to understand the underlying principles of contracts to better understand how you can manage your risk.

The Four cornerstones of South African contract law are:

  • Freedom of Contract
  • Sanctity of Contract
  • Good faith
  • Privacy of Contract
