GOVERNMENT HAS PROPOSED TO LAUNCH A STATE-OWNED CLOUD COMPUTING NETWORK.
Government has called
for public comment at the link below on a draft bill establishing a State Cloud Service to host SA
public and private data.
The amendments deal with several important
elements:
- to strengthen the capacity of the State to deliver services to citizens,
- ensure informed policy development based on data analytics,
- promote South Africa’s data sovereignty and the security thereof.
The National Data and Cloud Policy will create space for SITA and the CSIR to operate the government-controlled cloud by limiting and regulating the three dominant cloud computing platforms — Amazon Web Services, Microsoft Azure, and the Google Cloud Platform.

The Minister of
Communications and Digital Technologies invites you to comment on the South
African Postbank Amendment Bill.
The Amendment Bill provides:
- For the creation of a new holding company to facilitate establishment and registration of a Bank Controlling Company (BCC) in terms of the Banks Act.
- For matters connected therewith and other sections of the Postbank Act impacted by the change in the Postbank ownership structure.
The Bill allows for the separation of the Postbank from the SA Post Office and plans to convert Postbank into a fully-fledged bank with its own banking licence. DISCRIMINATION AND EQUALITY LAWS PROPOSED FOR SA.
Government has called
for public comment at the link below on a draft bill that broadens the definitions and scope of
equality and discrimination.
The amendments deal with two key elements:
- The prevention of unfair discrimination;
- The promotion of equality.
The first part of the Bill (clauses 1 to 3) aims to improve the protection of complainants against discrimination. This will be done by broadening and amending the scope of the definition of ‘equality’ by indicating that it includes equal rights and access to resources, opportunities, benefits and advantages.
The definition of ‘discrimination’ will also be broadened by indicating that intention to discriminate is not required. The bill states it is the effect that matters and makes it easier for complainants to make out a case of discrimination.
The bill adds two new subsections:
- The scope of the prohibition of unfair discrimination is extended to any person who causes, encourages or requests another person to discriminate against others. This enables legal proceedings against such a person.
- Provision is made in the bill for joint and several liability which entails that both the employer and the employee can be held liable for discrimination.
The amendment bill will also prohibit retaliation against a person who exercised his or her remedies in terms of the Act.
